SMS Communication Service Opt-In Policy (For QSR Operations)

Sync’d is committed to providing efficient and reliable SMS communication services to support the internal operations of QSRs (Quick Service Restaurants). This SMS Opt-In Policy outlines how we obtain consent from QSR owners/managers to send crucial operational messages to their designated employees, ensuring transparency and compliance with relevant regulations and industry best practices.

2. What You Can Expect from Our SMS Service

Our SMS service is designed exclusively for internal team communication within your QSR. By opting in, the QSR (via its authorized owner or manager) agrees for designated employees to receive text messages from Sync’d regarding:

  • Shift schedules and changes: Updates on employee work schedules, shift swaps, and cancellations.
  • Operational alerts: Notifications about equipment malfunctions, inventory shortages, or urgent procedural changes.
  • Urgent announcements: Critical information requiring immediate attention from the team (e.g., store closures, safety alerts).
  • Internal team coordination: Messages facilitating efficient daily QSR operations.

Message Frequency: Messages will be sent on an as-needed basis to support QSR operations. Message frequency will vary based on operational requirements.

Message and Data Rates: Message and data rates may apply. Please advise your employees to check with their mobile carrier for details.

3. How to Opt-In (Obtaining Express Written Consent from QSR Management)

We require explicit “express written consent” from an authorized representative (e.g., owner, manager) of the QSR before sending any text messages to their employees. We offer the following methods for the QSR to opt in:

A. Service Agreement/Onboarding Form Opt-In (Recommended for Verification):

  • Process: As part of the onboarding process for Sync’d services, the QSR owner/manager will complete a digital or physical service agreement or dedicated onboarding form.
  • Designated Contact & Employee List Upload: This form will include sections for the owner/manager to:
    • Provide their own contact information as the primary service contact.
    • Upload or manually input a list of mobile phone numbers for the specific employees who are authorized to receive these operational SMS messages.
  • Clear Disclosure: Adjacent to the section where employee phone numbers are provided, there will be a clear and conspicuous statement such as:
    • “By providing employee mobile numbers and clicking ‘Agree’/’Submit’, you, as an authorized representative of a QSR, confirm that you have obtained consent from these employees to receive recurring operational text messages from you/your business at the numbers provided. Message and data rates may apply. Message frequency will vary. Consent is not a condition of any purchase or service.”
  • Checkbox: There will be a checkbox that the owner/manager must actively select to confirm their consent and attest to having obtained employee consent. This checkbox will be clearly labeled, e.g., “I confirm that I am authorized to enroll these employee numbers and have obtained their consent to receive SMS messages for operational purposes from the business.”

B. Dedicated Management Portal Opt-In (If Applicable):

  • Process: If your business provides a dedicated online portal for QSR managers, they may add/manage employee contacts and their SMS preferences within this portal.
  • Clear Disclosure within Portal: When adding or enabling SMS for an employee, the portal interface will display a clear disclosure statement similar to the service agreement example, requiring the manager to acknowledge having obtained employee consent.

4. Employee Opt-Out Instructions

Individual employees who receive messages can opt-out at any time:

  • To stop all messages: Employees can reply STOP to any message they receive from us.
  • Confirmation: The employee will receive a single confirmation message stating that they have been unsubscribed and will no longer receive messages from your business for operational purposes.
  • Alternative Opt-Out: Employees can also inform their QSR manager, who can then update the contact list through your business’ management portal or by contacting our support.

6. Terms and Conditions & Privacy Policy

By opting into our SMS service, the QSR (via its authorized representative) also agrees to our full Terms and Conditions located at [Link to your Website’s Terms and Conditions] and our Privacy Policy located at [Link to your Website’s Privacy Policy]. These documents provide further details on data usage, privacy practices, and other important information relevant to both the QSR and its employees’ data.

7. Age Restriction

Our SMS service is intended for employees who are of legal working age for the QSR industry in their respective jurisdiction. By opting in, the QSR confirms that its enrolled employees meet the minimum age requirements.

8. Changes to This Policy

We reserve the right to modify this SMS Opt-In Policy at any time. Any changes will be posted on this page, and we encourage QSR owners/managers to review it periodically. Continued use of our SMS service after any modifications indicates acceptance of the updated policy.
